Terms of Service

StayLoyal Software Inc. provides tools for merchants to create and manage digital loyalty cards, customer enrollment, Wallet delivery, and related reporting. You must be legally able and authorized to bind the business that owns your workspace.

You are responsible for the accuracy of your business information and for maintaining the security of your account, staff access, scanners, and credentials.

You control each loyalty program and are responsible for its rewards, disclosures, expiration rules, customer communications, and compliance with consumer-protection, marketing, privacy, tax, and accessibility laws.

You may not use StayLoyal for fraud, unlawful discrimination, deceptive promotions, unsolicited messaging, credential sharing, security testing without permission, or activity that harms customers, Wallet platforms, or the service.

You may collect only customer information you have a lawful basis to use. You must provide any merchant-specific notices and honor customer access, correction, deletion, and opt-out requests that apply to your business.

StayLoyal processes customer information to provide the service. Our Privacy Policy explains our own collection and processing practices.

You may create and preview draft loyalty cards before subscribing. Activating a card requires a selected paid plan. When offered, a trial begins at Checkout and converts automatically to the selected monthly plan unless canceled before the trial ends. A payment method is required and taxes may apply.

You can manage plans, payment methods, and cancellation from Billing. If a subscription ends or remains unpaid after any stated recovery period, active loyalty cards may be paused and customer Wallet passes may become inactive. Drafts and business data remain available, subject to our retention policies.

Plan usage limits are enforced on the server. Customer-pass capacity counts current non-revoked, non-expired personalized memberships, while historical issuance remains recorded for analytics. A Wallet save is counted once for each unique pass and Wallet platform when StayLoyal authorizes the save flow. Downgrading does not delete existing data, but new enrollment or save activity may be blocked until the account is within the new plan limits or is upgraded.

Apple Wallet, Google Wallet, Stripe, Supabase, Vercel, Cloudflare, and other third-party services have their own terms and availability. StayLoyal does not control their review decisions, outages, device behavior, or account restrictions.

We may modify, suspend, or discontinue features to protect security, comply with law, or maintain the service. We do not guarantee uninterrupted or error-free operation.

You retain ownership of your business names, logos, program content, and customer relationships. You grant StayLoyal the rights needed to host, render, distribute, and update that content through the service.

StayLoyal and its software, branding, and documentation remain owned by StayLoyal Software Inc. Feedback may be used to improve the service without obligation.

The service is provided on an as-is and as-available basis to the extent permitted by law. StayLoyal is not responsible for the value, fulfillment, or legality of merchant rewards or for indirect, incidental, special, consequential, or lost-profit damages.

To the extent permitted by law, StayLoyal's aggregate liability relating to the service is limited to the amount you paid StayLoyal during the three months before the event giving rise to the claim.

We may update these terms and will identify the effective version. Material changes may require renewed acceptance. You may stop using the service at any time; provisions that should reasonably survive termination will continue.
